3. Thomas Bayley, gentleman, of Preston Brockhurst.
For settling and assuring certain lands on certain trusts Sandford grants to Evans the 2 pieces of land called the Upper Bottom Piece alias the Feggy Piece and the Lower Bottom Piece in the Isle of Up Rossall in the holding of John Weston; to hold to Evans his heirs and assigns to the use of such person and for such uses as Humphrey and Elizabeth Sandford shall by any deed jointly direct, and in default of such direction to the use of Humphrey Sandford for his life, and on his death to the use of Thomas Bayley for 500 years on trusts aftermentioned, and after the death of Sandford subject to the term of 500 years to the use of Elizabeth Sandford for her life and on her death to the use of Humphrey Sandford his heirs and assigns for ever; and as for the 500 years it is agreed between the parties and the term is limited to Bayley on this special trust and confidence that Bayley shall out of the rents and profits of the pieces of land or by demise sale or mortgage for all or part of the 500 years or any other way raise a sum not exceeding £600 to be paid to such person or persons and for such uses as Elizabeth Sandford shall whether sole or covert and notwithstanding her coverture by any deeds direct and in default of such direction in trust to pay the £600 to the younger son and sons, daughter and daughters of Humphrey and Elizabeth in such a way as she directs by deed, and in default of such direction in trust for Bayley to pay the £600 to the younger sons and daughters share and share alike with interest for the same to be computed from the beginning of the 500 years at 4% such original portions to be paid to such younger children when they attain 21 or be married, whichever happens first, and the interest thereof to be paid and applied in their education and maintenance or otherwise for their advancement when Bayley thinks fit; Sandford covenants that he has an absolute estate of inheritance in fee simple without any power to make it void, and has absolute power to convey the property; and at the request of Evans, but at the cost of Sandford, H.S. will make further assurances in the law of the premises; and Bayley shall not be accountable for any money to be received by virtue of the trust in him reposed any otherwise that he, T.B. shall be accountable for such sums as he shall actually receive and that he shall out of the rents and profits of the premises reimburse himself all expenses sustained in the execution of the trust.
